Technical, genuine rapes different: Singh

At a time when stricter rape laws need to be implemented with determination, people are also looking at the other side of the story, trying to differentiate ‘genuine’ rape from ‘technical’ rape, thus diluting the seriousness of violent rape cases.
Activist and advocate Abha Singh says records show that only 10 per cent are actual rape cases and the rest are technical rapes. Physical intercourse on the pretext of marriage, love affairs etc. fall under the technical category and unfortunately, these cases subdue the gravity of violent rape cases. She said, “It’s time to differentiate rape into violent rape or gangrape and technical rape. Most technical rape happens with mutual consent, otherwise how can a man rape a woman through months and years?”
Citing the National Crime Records Bureau’s figures, she added that in 92.5 per cent rape cases, offenders knew the victims. “Since the conviction rate across the country is very poor (26.7 per cent), perpetrators need to be sent a stronger signal by convicting them with greater speed.”
Men’s rights activist and president of Vaastav Foundation, Amit Deshpande said, “Today’s rape laws are completely gender biased and promote extortion, which should be stopped immediately. Western countries, from where our law think-tanks deduce the acts, have provision for male rape too. Why not in our country?”
Referring to NCRB data, Mr Deshpande said that 74 per cent rape cases have been found to be false, just because Section 354 of IPC (outraging the modesty of a woman, molestation, stalking, groping etc) and 376 of IPC (rape) have been totally misused.
Demanding that rape laws should be gender neutral, Mr Deshpande said, “Rape with violence should be dealt with firmly. When Justice J.S. Verma came out with the new rape law after the December 16, 2012 gangrape, we met him and requested him to include the misuse clause too. But, unfortunately, it never happened.”
Adding to the misuse of rape laws, Ms Abha Singh said, “In the last four decades, rapes have increased by 873 per cent as per NCRB figures. Strong laws are required to check this.”
Refuting these assessments, Nirmala Samant Prabhawalkar, member of National Commission for Women said, “Almost every law is misused in every country, so the possibility of this could not be denied, but stricter laws are essential today. This is why in the last one year reporting of rape cases has increased and its results would be known when conviction starts taking place in courts. I agree that consensual rape cases are also registered, but the punishment is comparatively subdued and judges know the nature of rape cases.”
