CBI court frames charges against 6 retired judges in PF scam

GHAZIABAD: A special CBI court here framed charges of corruption, cheating and forgery against six retired district judges of Ghaziabad in the multi-crore provident fund scam.
Court also framed charges against 65 persons involved in the scam under various sections of the Indian Penal Code(IPC).
Special CBI judge AK Singh on Monday framed charges against six retired judges — RP Mishra, RP Yadav, AK Singh, RS Choubey, RN Mishra and Arun Kumar — who were district judges of Ghaziabad between 2001 and 2008.
CBI public prosecutor BK Singh said that these retired judges have been framed under various sections of the IPC and under Section 13 (2) read with 13(1) (d) of the Prevention of Corruption Act, 1988.
Singh also said that CBI court has ordered to begin trial from December 6 next month in the Rs 6.58 crore PF scam, adding that these retired judges are now out on bail.
The scam was unearthed in February 2008 after the then Ghaziabad special CBI judge Rama Jain registered an FIR in this regard, he said.
The Supreme Court had then directed Central Bureau of Investigation (CBI) to probe the scam.
On the direction of apex court, the agency began probe in the case in October 2008 and in July 2010, it filed a chargesheet in this connection.
"CBI named 71 persons, including six retired district judges of Ghaziabad, 35 court employees, in its chargesheet. On Tuesday, one of accused Rambabu Verma, who served jail for around five and a half years, confessed to his involvement before the special CBI judge Dr AK Singh, who later passed an order to release him," CBI public prosecutor BK Singh said.
Singh also said that these 71 accused were beneficiaries of crores of rupees allegedly withdrawn from the PF account of fourth-grade employees in Ghaziabad district court.

Harassment cases leave men@work feeling harassed

MUMBAI: This week, the human resources head of a top-notch consumer goods company recently spoke to the vice-president (marketing), gently advising him to tone down his habit of putting his arms around junior women colleagues. "He is this over-effusive, friendly person prone to physical display of affection to both male and female team-mates," the HR head told ET on condition of anonymity. "But with growing incidents of sexual harassment cases at workplaces, we wanted the person to correct his behaviour for his own sake. A friendly hug could also go against him."

Recent developments - a new act to prevent sexual harassment of women at the workplace and separate cases involving a chief executive officer, a Supreme Court judge and a prominent magazine editor - are finally forcing India Inc to adopt a 'zero tolerance' posture on sexual harassment.

But, at the same time, the heightened sensitivity and rigorous new codes of conduct are leaving male executives confused, awkward and perhaps even a little fearful over what is appropriate in their work-related engagement with women and what is not.

Unexpected Repercussions

"Some CEOs have told me their male managers are refusing certain postings where there are women-intensive roles," says Saundarya Rajesh, founder and head of Avtar Career Creators, a talent strategy consulting firm. "Men are now afraid their natural behaviours may be seen through a different lens and land them in trouble."

Adds a Mumbai-based senior manager at a consumer company: "My boss and my wife have asked me to watch my words and actions while dealing with female colleagues."

Such fears — both well founded and otherwise — are also causing other unexpected repercussions. "I don't have evidence, but I fear hiring of women may slow down as an immediate effect," says Zia Mody, managing partner, AZB Partners.

Many companies are swinging into action. At one level, they are tightening workplace codes to protect women. "Over the last week, an increasing number of corporates have asked us to look at their manuals, conduct trainings, check compliance with Vishaka guidelines (the name by which the new act is commonly referred to)," says Mody.

At another level, companies are also sensitising male employees and addressing their concerns and fears. About a dozen top officials and consultants ET spoke to said HR heads and company leaders are working overtime, gently correcting borderline behaviour and also addressing fears male managers have of committing a faux paus or being unfairly maligned by women colleagues.

RPG Group has kicked off etiquette workshops for men on how to behave in the workplace or even on social media to safeguard themselves. The group also conducts powerful story-telling sessions around such incidents to help leaders get a sense of what is right and what is wrong and help them pick up the essence of how to correct their behaviour. Vodafone India took some senior and mid-level managers for a similar workshop. The company is keenly stepping up gender diversity.

Men are being advised to avoid involuntarily sizing up women, putting up offensive or seemingly sexual screen-savers on computers and laptops. A general manager at a leading financial servicescompany had the 'gentlemanly habit' of making loud offers of dropping his junior women colleagues home if they happened to work late. "It was a harmless and helpful attitude. But we requested him to offer office cars," the HR chief of the company told ET, also on condition of anonymity. "It is better to be safe than sorry. We cannot put our organisation's reputation at risk."

Men need to be educated. "My interaction with several male employees during the course of my training programmes is that three-fourth of them don't even know what kind of behaviour could have sexual connotations or where they have crossed the line," says Priya Warrick, an etiquette trainer and clinical psychologist and president-cum-executive director of Priya Warrick Finishing School.

The etiquette school does gender sensitisation workshops for male employees through role plays and role reversals.

Man hangs himself over wife's extra-marital affair

Monday, Nov 25, 2013, 8:49 IST | Place: Mumbai | Agency: DNA
Jayesh Raut and wife Trupti in happier times.
Jayesh Raut and wife Trupti in happier times.
Fed up with his wife’s extra-marital affair, a 29-year-old man allegedly committed suicide by hanging himself from the ceiling of his Pratiksha Nagar residence in Sion. However, before ending his life, he recorded a statement on his mobile phone.
The deceased, Jayesh Raut, was upset over his 23-year-old wife Trupti’s illicit relationship with 38-year-old Rajesh Verma.  Jayesh, who was helping his mother run a flower stall outside Siddhivinayak temple in Prabhadevi, went into depression after he learnt that Trupti was two months pregnant with Rajesh’s baby.
“I love you Trupti. I can’t live without you. Trupti and her paramour Rajesh are responsible for my death,” Jayesh said before hanging himself.
On November 18, the  police said, Trupti had called Rajesh to her Pratiksha Nagar home after she had a fight with her husband and asked him to take her to his Virar home. On her way to Virar, Trupti received an SMS from Jayesh, asking her to see his video. After reading it, Trupti called Jayesh’s brother and asked him to rush to her husband’s house to save him.
According to the police, Jayesh and Trupti tied the knot eight months ago after a nine-year courtship.
However, for the past two months the two were having regular fights over the affair.
The Wadala Truck Terminus police on Friday arrested Trupti and Rajesh for allegedly abetting the suicide of Jayesh.
“We have booked Trupti and Rajesh, a divorcee, under Sections 306 (abetment to commit suicide), 497 (adultery) and 34 (common intention) of the Indian Penal Code (IPC). We have also seized Jayesh’s mobile phone. However, we have not found any suicide note,” said police inspector Sawalaram Agawane, adding that the mobile phone will be sent for forensic test.
The two have been remanded in police custody till November 27. Jayesh’s brother Hemant demanded that the police should register a case of murder against Trupti and Rajesh.

'Gender equality should also be in context of men

PUNE: There is an urgent need to change the mindset about men as perpetrators of crime and bring in "gender equality" in the context of men. These will be some of the key issues that a city-based NGO working for men's rights would highlight at its International Men's Day (IMD) celebration on November 19.
Members of Men's Rights Association, which works towards addressing issues concerning men and protection their rights, said here on Saturday that reinstating the value of men in society and initiating an open discussion among men about the issues and constraints they face will be the focus of IMD celebrations in the city. More than 60 countries will be observing the day, the members said.
The IMD celebrations will be held at Balgandharva Natya Mandir on Jangli Maharaj road at 4pm on Tuesday. Addressing the news conference, Mahesh Shinde, president of the association, said, "We are arranging some fun games with prizes to be won by the participants. We will offer gifts to all participating men and will also felicitate men who have endangered their lives for social causes. We are also expecting a few Marathi film actors to join us on that day."
Shinde also urged men, including those in powerful positions, to stop living in denial about men's issues and even their own vulnerabilities. "We urge male film actors to end the glorification of violent male protector roles. We call for the establishment of male studies departments in universities, besides a National Commission for Men and a men's ministry to create gender equality," he said.
Propagating the celebration of IMD, Shinde said there is an urgent need to change the mindset about men as perpetrators of crime. "Under the guise of women empowerment, serious imbalance is being created in the society, by giving undue and unfair advantage to women. This is against the principle of natural justice. The IMD celebration is in recognition of the selfless sacrifice that men make for their families, parents, wife, sisters, and children in this age of constant criticism, male bashing and misandry in popular culture," he said.
Shinde argued his case with statistics of suicides. "In 2012, 88,453 men killed themselves. The rate at which the suicide rate of men has increased in the last 17 years is almost double as compared to women. Yet, no serious measures have been taken up by the government," he said.
"According to our survey, 84% of urban Indian males find domestic violence against men by women funny, and that abused husbands are not male enough," he said. "India as a country is famous for its family system. Not much will be left of it if women continue to "abuse" benefits accorded to them and men's value and rights are not reinstated," he added.
Men's Rights Association is a 500-member strong NGO which arranges free counseling every Sunday at 4pm at Sambhaji Park, Pune for men in distress.

The Tehelka letters: Tejpal says it was a totally consensual encounter

As a special investigation team of Goa Police reached Delhi to question Tarun Tejpal who has been charged with sexually assaulting a woman colleague, conflicting reports emerged in the media of the nature of encounter between the Tehelka founder and the young woman.
Tejpal issued an official statement on Friday offering his "fullest cooperation to the police and all other authorities". In reports that appeared in several media outlets including The Hoot and The Indian Express, Tejpal and his alleged victim faced off indirectly on what exactly happened during the magazine's 'Think' Festival in Goa two weeks ago. Here are some excerpts from the Tehelka letters.
'This is the easiest way for you to keep your job'

The Tehelka letters: Tarun Tejpal says it was a fleeting, totally consensual encounter

Tejpal and his alleged victim faced off indirectly on what exactly happened during the 'Think' Festival in Goa.

The news portal Delhi Durbar reported that in her email to Tehelka Managing Editor Shoma Chaudhury, the young woman wrote Tejpal had sexually assaulted her "at Think on two occasions last week". She accused Tejpal, whom she had known since she was a child, of molesting her in the elevator of a five star hotel on their way back from actor Robert De Niro's hotel suite.
She said she had resisted Tejpal's attempt at sexually assaulting her and reminded him of her friendship with his daughter who happened to be her best friend. The Durbar report said Tejpal allegedly "penetrated" her with his hands and told her "Well, this is the easiest way for you to keep your job."
There has been an untoward incident
Chaudhury, in an internal letter to her colleagues, described the incident as an "untoward incident."
"This may come as a rude surprise to many of you. There is a letter from Tarun appended to this mail. There has been an untoward incident, and though he has extended an unconditional apology to the colleague involved, Tarun will be recusing himself as the editor of Tehelka for the next six months," she wrote.
'I feel impelled to atone further'
Tejpal, in a letter to Chaudhury said he has tendered an unconditional apology for "misconduct to the concerned journalist" but felt impelled to atone further. "Because it involves Tehelka, and a sterling shared legacy, I feel atonement cannot be just words. I must do the penance that lacerates me," he said.
He offered to recuse himself from the editorship of Tehelka, and from the Tehelka office, for the next six months.
'The complete truth vs the honorable thing'
On Friday, in a strongly worded statement, Tejpal responded to allegations of sexual assault levelled against him by saying that "the complete truth and the need to do the honourable thing can come into conflict".
"For four days, as demanded by Shoma Chaudhury, the managing editor, and the recipient of the complaint, I have tried to do what was honorably demanded of me. On Tuesday I issued an apology for the alleged misconduct, as desired by the journalist through Shoma Chaudhury," he said.
He urged the police to obtain, examine and release the CCTV footage so that "the accurate version of events stands clearly revealed."
'Sexual liaison'
In a letter Tejpal addressed to the victim and published by the Indian Express, the Tehelka editor admitted to what he termed as a "sexual liaison" despite the woman's "clear reluctance".
"It wrenches me beyond describing, therefore, to accept that I have violated that long-standing relationship of trust and respect between us and I apologise unconditionally for the shameful lapse of judgement that led me to attempt a sexual liaison with you on two occasions on 7 November and 8 November 2013, despite your clear reluctance that you did not want such attention from me," Tejpal wrote.
Tejpal later told the Express that the "internal letters were demanded and done by Shoma as she insisted on closing a contentious issue through the sought apology". He said his version from first moment was totally different."
'He sexually molested me'
However, the woman journalist responded to Tejpal's statement indicating that the truth was something else other than what she was insinuating. The Express quoted her as telling sources that it wasn't an attempt at sexual liaison but that "he sexually molested me, on two separate occasions and that he violated my bodily integrity and trust."
'Totally consensual encounter'
Tejpal's letter of unconditional apology to the victim differed in tone and text from the one he purportedly sent to his friends. Outlook published excerpts of the letterthat said his "actions so far were out of an attempt to preserve the girl's dignity and on Shoma's adamantine feminist-principle insistence that I keep correct form by apologising."
"The truth is it was a fleeting, totally consensual encounter of less than a minute in a lift (of a two-storey building!) Now that a committee has been announced the truth will come out. As will the cctv footage. My life and work have been trashed on a total lie," Tejpal said.

Tarun Tejpal to start National Commision for Men(NCM) to protect Men from Women

Prominent journalist, well known writer and recent molester Tarun Tejpal today said that he will form a National Commission for Men or NCM to safeguard and protect the rights of men everywhere in India.

Tejpal who is currently on a 6 month vacation spoke to The J Timesfrom an undisclosed location and disclosed angrily 'Look,I am very unhappy with the way Men are being treated in this country ...especially by women. There is no one to uphold the sanctity of men anywhere in this country.Indian Men have been oppressed for far too long and this is why I am going to form a body for men,by men and of men'

Speaking further,he added ' I have already invited Actor Shakti Kapoor to be our President. He is an inspiration and a role model whose  fight for men's rights on the silver screen has been unparalleled.  He should have been awarded the inaugural Bollywood Centenary award but it was awarded instead to Waheeda Rehman,a woman. Yet another case of men being discriminated against.Furthermore,I have also extended invitations to former iGate and Infosys sexual harassment victim Phaneesh Murthy and actor Shiney Ahuja. I am also delighted to inform you that Godman Asaram and his  son Narayan Sai whose attempts at bringing Religion and Molestation together have been absolutely iconic, will also be joining the NCM'

'We have also approached CBI Director Ranjit Sinha to be our first CEO,his experience in law enforcement  and criminality is unmatched in the annals of India. His recent statement which implied that rape which cannot be stopped might as well be enjoyed proves that his dedication to men's safety issues is serious.' he insisted.

Tejpal continuing to address the issue of men's rights accused the National Commission for Women or NCW of being 'sexist' and completely 'feminist' .He said ' How can a body that is supposed to achieve Gender equality be only bothered about one gender  namely Women? How?! It is absurd and ludicrous. There is not a single Man on the National Commission for Women. How can this be? I plan to introduce a bill in Parliament called the Men's Reservation Bill, which will compulsorily provide Men with 33% reservation in the NCW.'

When asked about the specific case of Mens rights abuse,Tejpal shouted ' Look at Mallika Sherawat! She recently terrorized so many men on a TV show. She made them perform one demeaning task after another and treated them violently in an effort to achieve married status. Is this not a case of pre-meditative dowry harassment? '

Lastly, he added ' One of our members is a very aspiring, hard working Knife and  Machete salesman.'

'When he tried to sell a steel machete to a woman in a Bangalore ATM recently,he was accused of assault!Yet another case of Men being harassed by Women. What nonsense is this?! It is to avoid and fight things like this only that I am going to start the NCM.'

Need for gender neutral laws

Recently the Union Cabinet accepted a proposal to grant an ex-wife a right in the future inheritance of her ex-husband. It is awaiting the nod of Parliament. The logic behind the controversial proposal befuddles me. Not even in the liberal laws of the West does a divorced woman have a right in the future inheritance of her ex-husband. Children from the marriage have rights and it is the same in India too.
Let us examine who it is going to benefit — not the marginalised section of society where abuse of women is rampant. There is hardly any protection for the women who work as maids and daily wagers. In this class of society, it is the woman who works hard while the husband squanders his money on drinks and gambling. They barely have a roof over their head, so there is nothing to inherit.
As per available statistics, 37% of the Indian population lives below the poverty line. The controversial proposal is going to affect mostly the middle class and the upper class. In this class, most of the women are educated and many have their own careers. Hence the reason for framing such a law is not clear. This class of women have the capacity to stand on their own feet.
An equal share in marital property acquired during the married life seems fair and equitable. It is a fact that in the educated class divorces are on the rise and I am afraid that the proposed law may create havoc in the family and society.
The proposed law does not even state for how many years the couple should have been married. The amount of compensation is also left to the discretion of the judge. In many cases, there may not be more than one piece of property to inherit. The law can be implemented easily only if the ex-husband is the only child of his parents. It will become highly complicated if there are siblings around. To make it more complicated, the proposed law states if the property cannot be sold, the ex-husband should compensate the woman with cash. How many people are cash-rich?
Let us look into a situation where a couple may get divorced in their 30s and the husband remarries. What happens to the rights of the second, legally wedded wife? It may be the second wife who has tended to her aged-in-laws. Again, what happens to the rights of the daughter of the family? It seems that the proposal has been framed on the surmise that most families are sitting on a pot of gold and it can be easily shared. In reality, it is not a fact. The problem is most associations dealing with women’s welfare are looking at issues only from one angle — daughter-in-law’s angle — forgetting that women are also mothers, mothers-in-law, sisters and daughters. Justice to one category of women cannot be at the expense of other categories.
Imagine the plight of an elderly widow if she has to fight lawsuits after the demise of her husband. Even a will may not solve the issue as unscrupulous women with the aid of unscrupulous lawyers may go to court. We are all aware how slow our judicial system works and one will be fortunate if cases get decided in one’s lifetime.
The ultimate beneficiaries may be only lawyers. The need of the hour is gender neutral laws so that the fabric of society will not be damaged.

Magistrate charged with sodomy, FIR lodged

PURNIA: A case of sexual exploitation of an alleged juvenile criminal, now cooling heels in Purnia remand home, by a senior magistrate, who is also the in charge of the remand home, has come to light.
The sexual exploitation of a teenage criminal Kishore, who is in judicial custody at a remand home for his alleged complicity in an attempt to murder case came to light after his father approached the Juvenile Justice Board in Purnia on Wednesday, official sources said. Purnia DM Manish Kumar Verma promptly ordered an inquiry into the affair by the additional district magistrate (departmental inquiry) when it came into the public domain here, sources said.
Kishore, according to the complaint lodged by his father, was summoned by a senior magistrate Rajeshwari Pandey, currently holding charge of the remand home, to his residence, official sources said. He was brought to the magistrate's house in a government vehicle. The accused Kishore was not only made to do all the grinding domestic chores at the magistrate's house, but was also allegedly sexually exploited by the magistrate concerned for three consecutive days, sources said.
When the boy was brought back to the remand home on Monday, he was allegedly asked to keep his mouth shut, and not reveal his sexual exploitation. The magistrate concerned also extended a bait, saying he would help him in his exoneration of the murder attempt case if he kept the secret close to his heart, sources said. The boy, however, revealed everything as to how he was made to the do domestic chores and also sexually ravaged by the remand home magistrate when his father visited him on Wednesday, sources said.
ADM (departmental inquiry ) Rajendra Ram on Thursday said he has submitted the inquiry report to the district magistrate. He, however, did not reveal the contents of the report.
Meanwhile, Khazanchihat police station has, following Purnia SP Kim's directive, filed an FIR against the errant magistrate Rajeshwari Pandey after the Juvenile Justice Board forwarded the complaint lodged by the boy's father, SHO Arbind Kumar told TOI on Thursday.

Woman, four others held for husband's murder in Maduravoyal

CHENNAI: The Chennai city police arrested a woman and four men in connection with themurder of her husband in Maduravoyal on Thursday.

The murder of Raj Kumar, 29, a resident of Astalakshmi Nagar in Maduravoyal, came to light when a police team was checking vehicles on the Chennai-Bangalore national highway at 4am on Thursday.

The team, lead by sub-inspectors Sebastian and Ezhumalai of the Maduravoyal police station, stopped four men as they were returning to Kancheepuram on two bikes after the murder. The police got suspicious when they noticed blood stains on the shirt of one of the accused men.

During questioning, the man claimed that he was injured on Thursday night. However, he failed to show the wound to the police personnel.

The police took the suspects into custody. During questioning, they confessed to have killed Raj Kumar at his home as directed by their boss, Cheyyar Durai.

Police personnel went to Raj's house and found his dead body in the hall. His wife Vidya, 25, and her five-year-old daughter Deepika were sleeping in the bedroom. They took Vidya into custody for questioning. Preliminary inquiries revealed that Vidya and her boyfriend Manikandan were behind the murder of her husband.

Vidya had fallen in love with Raj Kumar eight years ago when they were working at a private export garment company in Porur. They got married and lived in a house in Maduravoyal. After a while, Vidya allegedly developed an extra marital affair with Manikandan, who was her colleague. Raj Kumar asked his wife to snap her friendship with Manikandan. However, she refused to do so.

Raj Kumar said to have harassed his wife over this issue. Manikandan allegedly devised a plan to eliminate Raj Kumar when Vidya told him about the torture she suffered at her husband's hands. He engaged Cheyyar Durai of Kancheepuram to eliminate Raj Kumar. Durai arranged four hooligans -- Perumal, Giridharan, Saravanan and Senthil - to execute the plan.

The four men came to Maduravoyal from Kancheepuram on two bikes to kill Raj Kumar. They called Vidya on her mobile after reaching her house. Vidya opened the door and allowed them to enter the house while Raj Kumar was sleeping in the hall. She held her husband's legs tightly and the men killed him by cutting his throat with knives. As they were escaping on two bikes after the murder, police caught them.

Leaving the door unlocked, Vidya went to sleep in the bedroom with a dream of cooking up a story about her husband's murder. But her dream was shattered when the police nabbed the murderers.

Police have launched a manhunt to nab Manikandan and Durai.

Chennai city police commissioner S George commended the police personnel for apprehending the suspects.

"We will reward the police personnel appreciating their effective work," Anna Nagar deputy commissioner of police S Xavier Dhanraj told TOI.

Raj Kumar's dead body was sent to the Kilpauk Medical College Hospital for postmortem.

‘Men are gradually becoming vocal about sufferings at hands of women’

Men's Rights Association, a Pune-based NGO, has seen more than 500 registrations in the three years since its formation, with activists terming the response as a sign of "imbalance in society under the guise of women empowerment".
Alleged misuse of Section 498 A of the Indian Penal Code (anti-dowry law), harassment at workplace and pro-women legal provisions when it comes to giving maintenance to wives after divorce are some of the major reasons for the hardships faced by men, they claimed.
"Our association was formed three years ago to help men in distress and take up at different governmental levels the issues faced by them. Our membership crossed the 500-mark in such a short span. On an average, we receive two to three calls daily from men in distress. We help victims of gender imbalance caused due to flip side of women empowerment," said activist Deepak Joshi.
On International Men's Day on Tuesday, the association organised a public awareness campaign through posters and a signature campaign at Balgandharva Square in the city among other areas.
"In the past, many powerful patriarchal men considered it unmanly to celebrate the International Men's Day. Such mentality meant men who hit back at abusive women are 'real' men and who take the abuse without reacting are not. But the situation is changing now and men are becoming vocal about their sufferings at the hands of women," Joshi said.
The Men's Rights Association offers personal and legal counselling to affected individuals (mensrightsassociation.org). "We arrange a meet every Sunday at 4 pm where motivational speeches are arranged. These sessions help a lot to affected men," said another activist.
The association has not only helped men fight "false" legal cases filed by their wives, but also advocated the cause of changing the "anti-male" legal system, he said.
"We believe in gender neutral laws unlike a section of feminists who take pride in blaming a section of society for women's problems. We are striving hard to bring a legal system that would do justice to men and ensure gender equality," said an activist.

Man posts suicide note on social website, kills self

ROHTAK: A 30-year-old man allegedly hanged himself at his residence after posting a suicide noteon a social networking website, police said on Thursday.

Naveen Arora, who worked as Data Entry Operator at Maharishi Dayanand University, had uploaded his suicide note on the social networking website last night.

Arora's body was found hanging from a ceiling fan this morning by a family member, police said.

As per preliminary investigation, Arora was apparently upset with his wife over some issue, which he mentioned in his suicide note, police said, adding that they are probing the case to find out the reason behind his extreme step.

Arora's body was returned to his kin after postmortem, they said.

Case filed against Manmohan Singh, Sachin Tendulkar on Bharat Ratna award

The awarding of Bharat Ratna to Sachin Tendulkar was drawn to the court on Tuesday with a petitioner challenging the Centre's decision to bestow the honour on the just-retired cricketer and alleging a 'conspiracy' to ignore hockey legend Dhyanchand.
A local advocate Sudhir Kumar Ojha, in his petition filed in the CJM S P Singh's court, named as accused Prime Minister Manmohan Singh, Home Minister Sushil Kumar Shinde, Sports Minister Bhanwar Jitendra Singh and the secretary to the union home department besides Tendulkar himself for selecting the star cricketer for the honour in a 'conspiratorial manner' soon after his retirement from all formats of the game.
He brought charges against them under sections (offences relating to cheating and dishonesty) 419 (punishment for cheating by personation), 417 (punishment for cheating), 504 (intentional insult with intent to provoke breach of peace) and 120(B) (punishment of criminal conspiracy) of the Indian Penal Code.
Ojha alleged in his petition that the government has cheated the people and hurt their sentiments by going back on its own earlier decision to give the highest civilian honour to Tendulkar and Dhyanchand taking into account a raging debate on the issue and recommending only the cricketer.
He alleged that soon after the 'Master blaster' bid adieu to the game, they conspired to select him for the award for his contributions to the sport and ignore Dhyanchand.
The petition said none of the distinguished persons like former prime minister Atal Bihari Vajpayee, socialist leader Ram Manohar Lohia or other cricketers who had brought glory to the country had been considered for the award.
"But a millionaire like Sachin Tendulkar has been given the award under a conspiracy," the petition said.
Ojha has made JD(U) MP Shivanand Tiwari, who spoke out against the Centre on the issue yesterday, a witness in the case.
The CJM admitted the case and fixed December 10 for the hearing in the matter.
The Centre had announced the decision to confer Bharat Ratna on Tendulkar within hours of his bidding adieu to cricket in Mumbai last week.

HC doubts 100% burns victim’s dying declaration, acquits husband

MUMBAI: Refusing to believe that a 19-year-old woman with 100% burn injuries could narrate and sign a dying declaration, the Bombay high court recently ruled that a youth serving life imprisonment for his wife's murder was not guilty.

A division bench of Justice P V Hardas and Justice Revati Dere ordered that Kolhapur resident Samir Awati (31), who was arrested eight years ago, be released from prison.

"Both the dying declarations are not free from infirmities and it would be extremely hazardous to place any reliance on them as they do not inspire confidence and therefore would have to be excluded from consideration," said the judge and added, "the prosecution had utterly failed to prove the offence against Awati beyond reasonable doubt. We find that the possibility of the deceased Salama having committed suicide cannot be ruled out altogether."

Advocate Arfan Sait, counsel for Awati, argued the entire case against the accused rested on circumstantial evidence and the two dying declarations were highly suspicious. Awati was arrested in July 2005 for allegedly setting his wife ablaze for dowry. There were two dying declarations, one was signed and the other had a thumb impression. A sessions court in 2006 held Awati guilty and sentenced him to life imprisonment. Awati challenged his conviction and claimed that his wife had committed suicide.

The high court pointed to the statement of witnesses that Salama had burnt her fingers, was unable to talk or even hold a pen. "We find it incomprehensible as to how Salama could affix her signature on the statement when she had sustained 100% burn injuries," said the judges, referring to the signature which was extremely neat and properly placed. The dying declaration with the thumb impressions was also held to be suspect by the court.

"We find that despite Salama having sustained 100% burn injuries and her fingers being burnt, there are ridges and curves seen on her thumb impressions giving us reason to suspect the genuineness of the said dying declaration," said the court. The court also disbelieved the other evidence brought in by the prosecution, and acquitted Awati giving him "benefit of doubt".

Harried by wives, Chennai men make 5000 complaints this year

CHENNAI: Manikandan, 40, a businessman from Velachery, thought he was a well-respected husband. That is, till business hit a downswing. He says his wife, a teacher, now beats him up every day because he earns less than her.

While the world on Tuesday observed International Men's Day — there is such a thing, after all, "a global occasion to celebrate the positive contributions and diverse experience (sic) of being male"; ref. facebook.com/international.mens.day — a growing number of men are approaching the Association for Protection of Men with complaints about being put through the dishwasher by their wives.

Chennai men appear to have it worst. The organization has received 5,000 complaints from men in the city this year. Of these cases, 400 have resulted in petitions for divorce. In Mumbai, 2,000 men complained to the organization this year.

The complaints range from ego clashes to sexual torture. A fair number of husbands (30%) can't get their wives out of their hair, mostly due to ego clashes. Around 20% of the cases were about wives picking up fights with their husbands over living in a joint family.

A similar number of men said their wives were dissatisfied with them in bed and had got involved in extramarital relationships. Around 10% said their wives dragged them to all-women police stations and lodged false complaints against them. As many as 500 of the 5,000 complainants said they were beaten up by their wives.

Some of the complaints that the association receives border on the bizarre. A man from Washermenpet, for example, said he did not want to live with his wife because she forced his brother to have sex with her whenever he was on night duty.

National Crime Records Bureau statistics show that, across the country, a married man commits suicide due to marital or financial pressure every eight minutes. Social activist S Syed Ali says Indian society offers little space for men to show signs of weakness, complain or seek help. "Most men who come to us with complaints have put up with nagging or abusive wives for a long time," he said.

Supreme Court zeroes in on ‘harass’ judge; support for disclosure grows CJI lauded for probe order

New Delhi, Nov. 15: The Supreme Court appears to have identified the former judge who is accused of sexually assaulting at least two law interns while in office, sometime about two years ago.
On the Chief Justice of India’s directions, the court registry has checked the intern-assignment records relating to judges who retired in the past two years, sources toldThe Telegraph.
They said that while convention demanded that an intern work with a particular judge for only a month, the accused judge seemed to have insisted that the women interns work with him for six months.
According to the sources, the feeling among the higher judiciary is that the judge should be named, if only to end the speculation about the other judges who retired recently. So far, the accused judge has not been named.
Legal experts have complimented the Chief Justice for setting up a three-judge panel to probe the allegations after one intern came out with sexual assault charges on November 6. Since then, a second intern has made similar accusations against the same judge.
Such a panel has no precedent in the Supreme Court’s history, nor has any sitting or former apex court judge ever faced charges of sexual harassment at the workplace before.
Legal experts said the Constitution had no provision for the apex court setting up such a committee but added that the top court could certainly do so under the extraordinary powers granted to it by Article 142.
What the committee will do is question the first intern (she has been requested to appear before it on Monday, November 18) and then confront the accused judge.
If the panel prima facie finds truth in the allegations, it can direct the police to register an FIR. A PTI report said police have initiated a preliminary probe into the case.
If the judge is convicted of assaulting or using criminal force with intent to outrage a woman’s modesty (molesting her), he can be jailed for two years. A rape conviction can put him behind bars for life or at least 10 years.
The Judges Protection Act 1985 grants judges and former judges immunity from prosecution for actions committed in the discharge of their official duties. The immunity does not apply to cases of molestation or rape as such offences cannot conceivably be a fallout of a judge performing his job, legal experts said.
“(Even) if the offence was committed while he was a sitting judge, he is amenable to all the laws of the country that apply to all ordinary citizens,” said Jaspal Singh, a former Punjab and Haryana High Court judge who now practises as a lawyer in the Supreme Court.
“The allegations are very serious; the law will take its own course,” he added.
Asked if the judges’ panel had judicial sanctity, Singh said: “(Such) charges against a judge of the Supreme Court are a very serious matter. They involve the institution and therefore they (the court) want to verify the charges before taking any action.”
Senior counsel Dushyant Dave said the CJI had done “an extremely good thing” by forming the panel to probe a “brother judge”.
“That this is an in-house committee owes not to any legal requirement but more to propriety,” he said.
He added that the police must not act unless and until the panel asked them to register an FIR, for neither has the accused been identified yet, nor has any of the interns lodged a formal complaint.
“If any third party has lodged a complaint without proper material, it makes no sense,” Dave said.
He added: “It’s a very serious charge; the judge concerned has to face the music.”
