Woman accuses husband of rape

AHMEDABAD: A 32-year old woman has filed acomplaint of rape by her husband with Kagdapith police. Investigators said that the couple live in the same house on different floors for the last year after the wife filed a complaint for mental and physical harassment against the husband.
According to Kagdapith police, Heena (name changed), a resident of Kagdapith, filed a complaint for rape against her husband. According to her complaint, her husband forced his way into her residence in the morning and, taking advantage of the absence of other family members, raped her. She mentions that he raped time and again over the last year, threatening her with dire consequences if she spoke up.

G S Bariya, inspector of Kagdapith police station, said that the couple has not separated but live on the first floor and ground floor of a house. "The couple also has two children. We learnt that the victim had earlier registered a case of harassment and dowry demands against her husband, who works for a nationalized bank. Investigations are underway. We sent the victim and accused for a medical check-up to collect evidence," he said.

Sacked woman kills boss' son in west Delhi

NEW DELHI: After being sacked by her employer with whom she had an affair, a 26-year-old stockbroker's assistant stabbed his son to death at west Delhi's Mianwali. Then she attacked his wife and finally attempted to commit suicide with the same knife. Following medical intervention that saved her life, Asha was arrested on Friday. A probe revealed she was fired from her job after the victim, Varun Gupta, began planning to take over his father Sushil's business.

Asha, a resident of Nihal Vihar, had been a computer operator at Sushil Gupta's share trading office for three years. On September 2, she arrived at the Guptas' Ambica Vihar residence around 10.30pm, police said. Gupta was not at home but his wife Anita, son Varun and daughter Swati were present. Asha often came to Gupta's house, so no one thought anything was amiss.

Anita told police she was in the kitchen and Swati in her room when she heard Varun's screams from the drawing room. She rushed there to see him lying on the couch bleeding profusely. Asha was standing at the back of the couch with a blood-stained knife in her hand, she said.

Anita told police that in the minutes that followed Asha even tried to stab her but was overpowered by her with Swati's help. Asha then stabbed herself. Anita escaped with minor injuries. She said she called up Asha's father who took her to DDU Hospital. The Guptas took Varun to Global Bhatia Hospital with critical injuries to his stomach. Varun succumbed to his wounds and police registered a case of murder on basis of Anita's complaint.

Investigations revealed Asha had an affair with Sushil Gupta and was sacked when Sushil gradually shifted his capital from shares trading to real estate business which his son took over. Both Anita and Varun were probably aware of Sushil's affair. During interrogation, Asha reportedly told police that she held Varun responsible for losing her job and had planned to murder the Gupta family in revenge. "Asha was arrested for murder and remanded in judicial custody," DCP (West) Ranvir Singh said.

TN: Woman 'confesses' to husband's murder in reality show, surrenders

Chennai: A 38-year old woman, who confessed in a Tamil television reality show to abetting the murder of her husband by her paramour, surrendered before the police five months after the incident, which was initially treated as a case of sucide. D Sumathi was produced in a court in Tiruvarur district and remanded to judicial custody recently. Two days after her surrender, her alleged paramour T Rajan (49) also surrendered and was remanded to judicial custody, police said. The victim 46-year old S Dhanasekar was a headmaster in a government school and his wife Sumathi was also a teacher in another government-aided school, both in Tiruvarur district.

Sumathi had, along with Rajan, allegedly poisoned to death her husband on May 14 at their house in Marakadai. S Kannadasan, brother of the victim, claimed that soon after his brother's death, Sumathi herself admitted to the crime to family members, pricked by conscience. Later, she confessed to the crime in the TV show a few weeks ago. Police said murder charge has been slapped against Sumathi and Rajan.

Portuguese citizen charged with dowry harassment

Byappanahalli police have arrested a Portuguese businessman on charges of dowry harassment. Jimme Pereira D'Souza Bento (in pic), 48, from North Portugal and a resident of Old Madras Road, was arrested two-days ago based on a complaint by his wife Ana Luisa Onofre Alves, 45. The couple frequently visited the city on business and stayed at a rented apartment in Salarpuria Silverwoods Apartment on Old Madras Road. 

The complaint states that Bento forced his way into the flat early on Wednesday and demanded 50,000 euros from Ana. When Ana refused to give him the money, Bento not only beat her, but threatened to kill her by brandishing a knife. 

Ana managed to get away, rushed downstairs and screamed for help.Raju, a regular visitor to the apartment, heard her screams and informed the police who took Bento into custody. CMH hospital doctors confirmed physical injuries to Ana. 

Police have registered a dowry harassment case under 498(A) of IPC against Bento and remanded him to judicial custody. Cops say the couple had filed for divorce in a courts in Portugal.

Women above the age of 18 do not require permission from court to have sex: Renuka Chowdhary

New Delhi: Senior Congress leader Renuka Chowdhary has said that any girl who has attained the age of 18 years doesn’t require court’s permission to have sexual intercourse. This was in response to a controversial ruling of a Delhi-based judge that women are “morally and socially bound not to indulge in sexual intercourse before a proper marriage.”
 
Congress spokesperson Renuka Chowdhary said there was a difference between rape and consensual intercourse. She said it was unfortunate that there is ambiguity over how to differentiate between rape and sex. 
 
Additional sessions judge Virender Bhatt, in a controversial judgment issued earlier this month, had ruled, “Girls are, and if they do so, it would be to their peril and they cannot be heard crying later that it was rape.”
 
 
The judgment pertained to a case in which a man had been accused of raping his brother’s sister-in-law. The woman had claimed that the accused had raped her after deviously making her believe that she was his legally-wedded wife. 
 
The judge, who hears the cases of sexual offences against women at the fast-track court, acquitted the accused. 
 
Judge Bhatt in noted that there had been a “very disturbing trend” of false rape cases, where girls “voluntarily elope to explore the greener pastures of bodily pleasure”, and to escape harsh treatment from their parents, they “conveniently fabricate” a false rape case. 
 
He had said that women above the age of 18 years are mature enough to know the implications of their act when they go into a sexual relationship with a man. 
 

20-year-old cleared of rape charge

NEW DELHI: A youth accused of raping a minor has been acquitted by a Delhi court after it observed that the upper caste girl was tutored by her parents to "betray her love" for honouring their "social status". 

The court acquitted the 20-year-old boy after it found that the girl's testimony was "full of twisted facts" as her parents were opposed to her marriage with the youth since they belonged to different castes. "Prosecution witness 1 (girl) accepted the suggestion that her parents were opposed to her marriage with the accused due to caste factor," additional sessions judge Dharmesh Sharma said. 

"The said facts and circumstances demonstrate... that during the interregnum, the prosecutrix (girl) had been coached or tutored by her parents to sacrifice her feelings, betray her love for the accused and instead honour their social status... at the behest of her parents she testified falsely against the accused," the judge said, adding that the 17-year-old girl's testimony was "grossly contradictory". 

According to police, the youth had kidnapped the girl on May 28 with the intention of marrying her. A missing complaint in the matter was lodged by the girl's mother. agencies

Couple commits suicide, alleges harassment by sister-in-law

JALANDHAR: A young couple committed suicide in nearby Jandiala village by consuming celphos tablets and left a suicide note blaming a "false" complaint of dowry harassment filed by their sister-in-law. They had earlier told Hoshiarpur Police, where a complaint of dowry harassment was pending against them, that the complainant was demanding Rs 50 lakh from them to settle the matter.
Harkamal Singh and his wife Amarjit Kaur committed suicide on Tuesday. Sadar police station SHO Onkar Singh Brar said police have recovered a suicide note in which the victims blamed Rajwinder Kaur, wife of Harkamal's brother Sartaj Singh, who is living in Canada. The note said that Rajwinder was tormenting them through a false complaint in which Harkamal's mother was also named.
Police have booked Rajwinder, her mother Malkiat Kaur and a cousin under section 306 of IPC. Earlier, the couple had told police during inquiry of her dowry harassment complaint that she was demanding Rs 50 lakh to withdraw the complaint and settle the dispute, police said. Rajwinder filed the complaint after Sartaj could not manage to take her along to Canada, they said.

NRI woman throws slipper at judge in Vadodara

VADODARA: An angry non-resident Indian (NRI) lady threw a slipper at a judge in the family court here on Tuesday afternoon. The lady identified as Tarlochana Zaveri was arrested immediately after the incident by the police. Zaveri has had a history of indulging in such acts in last few months. According to the police, Zaveri reached the family court at about 3 pm and threw a slipper at lady judge P M Sheikh.

She had filed for divorce from her husband and was fighting legal battle for maintenance. "Zaveri threw a slipper at the judge following which she was arrested. She is a British citizen and her case for maintenance is on in court. In the past too, she has attacked advocates. We had arrested her earlier too," said city police commissioner Satish Sharma.

Zaveri had created a ruckus in Alkapuri area some months ago in front of Sharma's residence as well. She has been accused of creating ruckus inside the court and also making allegations against her husband's advocate. The police said that she had even tried to strip herself at Raopura police station earlier.

Woman attacks female cop, held

GURGAON: A Delhi-based woman has been arrested for allegedly thrashing a woman constable. She also allegedly tore the uniform of the policewoman. The woman has been sent in judicial custody.

Khushi Saini from Janakpuri in Delhi, who works in a call centre in Gurgaon, was waiting at Udyog Vihar for a friend around 1am. After some time, the woman PCR No. 15 arrived there and woman head constable Amandeep went to ask Saini why she was standing there alone.

This allegedly infuriated Saini and she attacked the head constable and tore her uniform. The constable alleged that she tried to reason with Saini, but she would not listen. So, the police had to take Saini to police station. An FIR was lodged against Saini.

Man poses as bomber, attacks ex-wife's family

NEW DELHI: A man chose the most bizarre way to take revenge from his in-laws, whom he held responsible for his broken marriage. He posed as asuicide bomber and went on a rampage at his ex-wife's house in Jaitpur area of southeast Delhi. Armed with a 9mm pistol and two country-made revolvers, he shot dead his father-in-law, before opening fire on the rest of the family.

The accused, Vikram (30), entered the under-construction house in Meethapur extension around 1.30 am on Tuesday along with two friends. He wore a fake explosive belt with condensers and wires wrapped around his chest. They first fired several shots and stabbed Vikram's former father-in-law, Om Prakash (55), who was sleeping outside on a cot.

Om Prakash's son Jaiprakash was also shot after he ran outside on hearing the noise. Other members of the family, including Vikram's ex-wife Suman (29) were also seriously hurt after being attacked by the three assailants. Vikram had even threatened to blow himself up if anyone tried to stop him.

The three accused then tried to flee but Suman's second brother, Manoj, managed to pin Vikram down. Neighbours soon arrived at the spot and Vikram was handed over to the police.

Family members said that Suman and Vikram had married in 2009 but separated in 2010 following a dispute. The decision was mutual but Vikram had maintained that his in-laws were responsible for the separation.

"Suman had married another man from Haryana a year ago. This was not acceptable to Vikram and he began looking for an opportunity to take revenge," police said.

Vikram planned the attack after he learnt that Suman had come to meet her family for Dussehra. He procured firearms, sharp weapons and bombs and roped in his brother and two friends.

Locals said that Vikram was unemployed and an alcoholic. He lived with his brother and father in the same locality. He also used to allegedly harass Suman for dowry and had even assaulted her several times.

A case under section 302 IPC (murder) and other relevant sections has been registered against Vikram and his friends. Police have recovered a 9mm pistol and two country-made revolvers from him. Vikram was admitted to a hospital after being injured in the scuffle.

False rape charge lands woman in prison for 4 years

A woman has been sentenced to four years in jail for levelling false allegations of rape against a man, who later committed suicide as he could not bear the stigma of spending 72 days in jail for a crime he did not commit.
Last December when the country was witnessing unprecedented protests against Delhi gangrape incident, 35-year-old Chanchal Rathore had accused her 53-year-old landlord, Roopkishore Agrawal, of raping her. However, during the trial, Chanchal admitted that she was not raped.
According to her, she had a quarrel with Agrawal when he had come to collect rent and the money her husband had taken as loan from him. Additional Sessions Judge Savita Dubey, who was hearing the rape case, later ordered that Chanchal be tried for giving a false statement.
The judge even appeared as a witness in the court of Additional Sessions Judge Indira Singh, who sentenced Chanchal to four years in jail under Section 211b of the IPC (making false charge of offence with an intent to injure). She has also been slapped a fine of Rs 10,000, non-payment of which will fetch another six months jail term for her.
Chanchal, who claimed to work for an NGO, was also sentenced to six months in jail under Section 182 (giving false information with an intent to cause public servant to use his lawful power to the injury of another person). Both sentences will run concurrently.
Chanchal is also being separately tried for abetment to suicide, punishable with a seven-year jail term.
Chanchal's husband Sunil, who took the money from the landlord to buy a Tata Magic vehicle, is also an accused in this case, said Additional Public Prosecutor Hemant Mungi.
Agrawal was found dead in his home on March 17, nine days after he was released on bail. In his suicide note, he had blamed Chanchal for his ordeal and his decision to take kill himself.

नई दिल्ली, राज्य ब्यूरो। शारीरिक अंतरंगता किसी भी विवाह बंधन का एक महत्वपूर्ण अंग होता है। ऐसे में कोई महिला अपने पति से शारीरिक संबंध बनाने से इन्कार करती है तो यह बात उत्पीड़न की श्रेणी में आती है। यह तलाक का ठोस आधार भी है। यह टिप्पणी करते हुए दिल्ली उच्च न्यायालय ने एक व्यक्ति को पत्नी से तलाक लेने की अनुमति प्रदान की है।
न्यायमूर्ति एस. रविंद्र भट्ट और न्यायमूर्ति नजमी वजीरी की खंडपीठ ने मामले में महिला द्वारा निचली अदालत के फैसले के खिलाफ दायर याचिका को खारिज करते हुए निचली अदालत के फैसले को सही ठहराया है। निचली अदालत ने महिला के पति को इस आधार पर तलाक की अनुमति दी थी कि महिला पति से शारीरिक संबंधों से इन्कार व परहेज करती थी। महिला ने निचली अदालत के निर्णय को उच्च न्यायालय में चुनौती दी थी।
उच्च न्यायालय ने फैसले में कहा कि पति व पत्नी आठ-नौ साल से एक-दूसरे से अलग रह रहे हैं। पत्नी ने पति पर अपने परिवार से अलग होने के लिए दबाव डाला। बात न मानने पर पत्नी ने पति के साथ शारीरिक संबंध बनाने से भी इन्कार कर दिया। इस पर पति ने वर्ष 2007 में निचली अदालत में तलाक की अर्जी दाखिल की। निचली अदालत ने महिला को वर्ष 2009 में एक मौका दिया था कि रिश्ते की कड़वाहट को दूर कर पति-पत्नी फिर से साथ रहें। महिला पति के पास तो आई मगर उसने शारीरिक संबंध बनाने से इन्कार कर दिया। ससुराल आने के बाद भी महिला गुजरात में महीनों तक अपने परिजनों के घर रहने जाती थी। यह व्यवहार क्रूरता की श्रेणी में आता है।
खंडपीठ ने महिला के पति की उस दलील को भी स्वीकार किया, जिसमें उसने कहा था कि महिला ने उस पर उसकी महिला रिश्तेदार से अवैध संबंधों का आरोप लगाया, यह उसके लिए मानसिक उत्पीड़न से कम नहीं है। खंडपीठ ने कहा कि ऐसे में निचली अदालत ने व्यक्ति को उसकी पत्नी से तलाक की अनुमति देकर कुछ गलत नहीं किया।

Top judges admit India's justice system is a 'tragedy' as common citizens are ignored in favour high-profile cases

Speedy trials in cases involving rich and powerful defendants have perturbed not only the common people, but also the top judicial body in the country.
The Supreme Court, through a series of observations, recently admitted that the Indian judiciary was ignoring the common man while giving priority to rich, powerful and influential people in hearing cases - and said some serious introspection was called for in this regard.
There are 65,000 cases pending in the Supreme Court, a total of 42 lakh cases in high courts and a staggering 2.9 crore in trial courts.

SPEEDY JUSTICE
"Look at the tragedy in our country. Decision was rendered in January this year by the trial court and appeal has been heard and arguments completed. Here, appeals filed in the year 2005 against death penalty are not heard by us.
 
"Sometimes, I wonder at my system. Here is an appeal of the year 2013 which gets a quick hearing. In how many cases are we doing so? That's why poor man feels that the system cares only for known persons and the unknown persons (common man) gets ignored," a bench of justices H L Dattu and SJ Mukhopadhaya said on September 12 while dismissing the plea of former Haryana chief minister Om Prakash Chautala.
Chautala, who is serving a ten-year jail term in the teacher recruitment scam, had sought extension of his interim bail.
CASE PENDENCY
Another bench of Justice B S Chauhan and Justice S A Bobde while dismissing the anticipatory bail plea of IPS officer P P Pandey, accused in Ishrat Jahan fake encounter case, on August 12 said: "We are sorry to say that the court's time is being used by senior advocates and big criminals.
"We can say on oath that only 5 per cent of the time is being used for common citizens, whose appeals are waiting for 20 or 30 years. This court has become a safe haven for big criminals. You come here for the sixth or eighth time for anticipatory bail and we should hear as if we were a trial court." 
The issue was first brought to the fore in December 2011 by a Delhi High Court judge S N Dhingra, who said: "…criminal justice system needs overhauling so that the constitutional mandate of equality before law is made meaningful and it should not be the case that higher courts are kept occupied by the person with money or power, as is the case today".
Justice Dhingra issued an order that in all such cases where appellants are in jail and sentence is not suspended, courts should fix a time limit for disposing of such appeals.
Lawyer Manish Khanna, who has been fighting for speedy trial for the poor, said: "It is a well know fact that hearing pattern in most courts change when petitions of the rich and powerful come up. Senior advocates who appear for them get special attention."
Khanna, through an RTI query sought to know recently if the high court, after justice Dhingra's order put in place any policy on giving speedy hearing to persons in jail and the reply he got was "issue under submission to the authorities".

Supreme Court demands 22 special courts to try politicians 

The Supreme Court on Monday asked the Centre how far its order on August 5 to set up 22 special CBI courts to try corruption cases involving high-profile politicians and public servants has been implemented.
A bench noted in its order that "Solicitor General Mohan Parasaran frankly admits that the court's order has not been implemented". 
It said details must be provided failing which it will summon senior officials from the states. Parasaran said there have been delays in Andhra Pradesh, Punjab and Uttar Pradesh but other states have stated that they will make the special courts functional by November.
In its August 5 order, the apex court had said: "Governments of Andhra Pradesh, Punjab, Rajasthan and Uttar Pradesh are directed to sanction creation and/or establishment of the remaining Additional Special Courts within a month." 
"We further direct that all the 22 Additional Special Courts, for which the government of India had written to different state governments/union territories, should be made effectively functional by the respective states and the administration of Union Territories, by providing necessary infrastructure and provisions for budget. 
"As far as manpower is concerned, law secretaries of state governments and Union Territories are directed to get in touch with the administration of the respective high courts and ensure that suitable officers are made available for posting in the special courts within a maximum period of two months," the order had said.
The CBI had told the court that out of 22 additional special courts, 15 have been sanctioned.

Tihar flooded with under-trails

The Capital's Tihar jail is bursting at its seams with 13,253 prisoners - more than double its capacity of 6,250 inmates.
According to the prison's spokesperson Sunil Kumar Gupta, 75 per cent of the inmates are under-trials, many of whose appeals are yet to be heard.
"There is no denying that such a high percentage of under-trials in a jail is a poor reflection of the state of affairs of the criminal justice administration. 
"It is a fact that the common man goes into the general queue as far as hearings for bail and appeal are concerned while the rich and influential somehow manage priority hearings," said former Delhi High Court judge R S Sodhi.
Lawyer and civil rights activist Colin Gonsalves said: "The rich and powerful hire high-profile lawyers. 
"Their issues then automatically get precedence over the cases of poor man who may not even have a lawyer. 
"Therefore, the cases of the rich end up getting exaggerated importance many times eating up lion's share of the court's time."

Haryana youth offers to sell organs to pay off wife

KOLKATA, 6 JUNE: A youth from Haryana wrote to the President of India seeking his approval to sell his organs to pay his wife who had allegedly filed a "false" dowry case against him. The matter is now under consideration of the National Human Rights Commission.
Mr Sunil Kumar (in sns photo), a resident of Fatehgarh in Haryana, married on 26 June in 2009. A year after his marriage, his wife brought dowry harassment charges against him and asked him to pay maintenance.
According to Sunil, his wife brought "false" charges against him for monetary gain. Though he collected proof against the false claims through RTI application, it was ignored by the local court, he alleged in his letter to the President.
Sunil wrote the letter in May this year to the President explaining his financial constraints and how he is overburdened with loans. He said in his letter that since he is unemployed and has nothing to sell to pay the maintenance to his wife, he would like to sell his organs.
"Please permit mercy killing (euthanasia) for me and sell my body parts and organs so that my wife receives her maintenance," he wrote. The matter is now before the National Human Rights Commission.
Talking to The Statesman from Haryana, Sunil said that after his wife filed "false" dowry case against him in 2010 she "continuously blackmailed me to pay her Rs 10 lakh to settle the matter." Expressing his poor financial condition he surrendered to the police on 9 August 2010 and spend two days in judicial custody.
"But that was the beginning of our suffering. The judge even after knowing my mother's poor health sent her to judicial custody for four days. My mother who was discharged from hospital after a major tumour operation suffered paralysis after spending four days in Hawalati ward without medicine, food and proper care," Sunil said.
He said that in spite of bringing the facts with relevant proofs before the court, the judge did not consider them. "I even submitted evidence against the false charges collected through RTI Act. But even after her false claims without any evidence she got order in her favour," Sunil said. "But now I hope justice will be given as the matter is taken up by the NHRC. Otherwise, I don't have any option other than selling my organs to pay my wife," he added.
Mr Amarty Talukdar  of Save Indian Family Foundation (SIFF), said that extortion of money by abusing the dowry law is now rampant in India. "We are daily flooded with complaints from husbands who are falsely charged by their wives often to get financial advantage. The government should act now to stop its misuse," he added.

CJI Balakrishnan admits to misuse of dowry laws

NEW DELHI: Dealing a blow to women's rights activists who have been stringently defending the Section 498A provision of the Indian Penal Code, Chief Justice of India K G Balakrishnan on Saturday said that in some cases this section — that deals with matrimonial cruelty — was being `grossly misused'. 

Elaborating on false cases being filed in recent times, the CJI said that relatives not involved with a matrimonial dispute were unfairly implicated. But women activists have been lobbying for no change in the law. 

Faced with adverse comments from the CJI, National Commission for Women (NCW) chairperson Girija Vyas said that it was lack of awareness that led to false cases under 498A. "I would not like to use the term misuse. There is lack of awareness amongst people that is exploited by lawyers and police. We feel there is no need to review the law,'' Vyas said. 

CJI Balakrishnan added that it was because of cases of misuse that the recent amendments in the Criminal Procedure Code had been enacted by Parliament. He, however, added that while the amendments were acceptable they should have been discussed threadbare in Parliament before being passed. "The amendments are good. They have given relief to those arrested on false accusations. The police has to give reasons before they arrest anyone. Unfortunately, Parliament passed the legislation without discussion,'' Balakrishnan added. 

Commenting on the CrPC amendments, Vyas said that there had been demands from NGOs that the law be reviewed and the Commission was examining the matter.

New move by High Court, bail on first hearing

In a landmark decision the Punjab and Haryana High Court has decided to abolish its archaic, lengthy process of deciding regular bail applications.
Under existing procedures, an accused has to wait "few" months for his/her regular bail application to be decided. The court first issues notices to the concerned State government, seeks its response, summons the investigating officer (IO) if required, and hears the arguments before deciding on the application. The entire exercise normally takes at least four to five months. In fact, in some cases, the bail comes up for first hearing (after notices) after four months.

This procedure has now been scrapped. The high court, on the administrative side, has decided that from now on, all regular bail applications will be decided on the very first hearing. As per the new procedure, bail applications will be listed exactly a week after filing. The concerned State government/police agency will get a week to prepare its reply and IO summoned. On the first hearing the court will hear arguments of both parties, enquire from the IO and decide on the bail plea.
This decision — taken by a three-judge committee comprising Justices Surya Kant, Amol Rattan Singh and M S Chauhan — is likely to be implemented by November 6.
Due consultations with Advocate Generals of Punjab, Haryana and senior public prosecutor for Chandigarh, R S Rai, were held before the decision was taken. Taking note of the undue delays in the High Court in deciding regular bail applications, a body of lawyers had suggested an overhaul of the decades old system. Finding merit in the suggestion, the then Chief Justice had constituted the three-judge committee to look into the issue.
This development assumes significance as it will end the delay of several months, in some cases as long as nine months. All applications will be decided the same day. For speedy and effective implementation, the National Informatics Centre (NIC) will be told to make necessary amendments so that update of such cases is reflected in the daily list.
The new procedure will also apply to cases of "suspension of sentence". These are cases where a guilty after conviction moves High Court seeking suspension of his sentence. It came to light that such cases were also hanging fire for several months awaiting final disposal.
The new system for disposing bail will however, apply only to "regular" bail applications and not anticipatory bail applications. A regular bail application is filed in the high court after a person is sent behind bars by a lower court either after his arrest by an investigating agency or holding him guilty for an offence.
For anticipatory bail applications, "routine" procedure will be adopted. "The decision has been taken keeping in view the injustice caused to an accused or a convict who is made to rot in jail for no fault of his. It was noticed in umpteen cases that people were languishing behind bars just because their bail applications were not decided for several months. The new procedure leaves no room for delay. Now, all bail applications and petitions seeking suspension of sentence will be decided on the very first hearing," said a senior high court officer.

Man gets back newborn gifted to stranger by wife

TRICHY: A woman gifted her newborn to a stranger after she got estranged from her husband. Strange it may seem, but this is what a 20-year-old woman did. Moreover, she made the false claim that her 17-day-old male baby died soon after its birth. The woman belonging to thevanniyar community spilled the beans to the Arumbavur police in Perambalur district after her husband, a dalit, approached the police. On Saturday, the baby was traced and handed over to its father.

The love story of K Shanti and D Ranjit Kumar soured within a year of their marriage. It is alleged that Shanti resorted to these steps only to severe ties with her 21-year-old husband who she had married in October last year after a long courtship that started during their school days. She admitted that the baby was 'gifted' to an old man from Chennai. Shanti belongs to M G Puram and Ranjit is from Goundampalayam in Perambalur district. After wedding, Ranjit obtained a job at a rice mill in Goundampalayam itself.

The relation soured after Shanti became nine months pregnant and went to her mother's house. On September 25, Shanti delivered the baby at Cuddalore government hospital. As Shanti wanted to keep her whereabouts unknown to her husband she went to Cuddalore where she had a relative. However, Ranjit traced her and found her with the baby at the hospital on September 28 and returned. The following day, Shanti was discharged from the hospital.

During questioning, Shanti revealed that she gifted the baby to one Jaffar Hussein, 77, through the mediation of a hospital security personnel, Jesudoss. Jesudoss has also admitted to his role.

After Jaffar was traced, he handed over the baby to Arumbavur police inspector, Prakash, on Saturday morning.

Later, the baby was given to Perambalur District Child Welfare Committee (DCWC) which in turn, handed over the baby to his father with the condition the child will be monitored by the committee. Shanti stuck to her decision not to live with her husband, despite the DCWC members persuading her to go with him during a six-hour meeting on Saturday. "It is intriguing why Shanti suddenly changed her mind and refused to live with her husband. Our six-hour-long effort to find the truth did not bear any fruit as she kept mum except saying that she was not interested in him anymore," said DCWC chairman Mohammad Hussein Babu. Mystery deepened when we came to know that she had even named the baby "Sanjit" (after Santhi and Ranjit), the DCWC chief said.

Inspector Prakash said that a case cannot be registered against Jaffar as Shanti gave the baby to him out of free will and he returned the child anyway.

Air hostess files rape charge

GURGAON: A 48-year-old property dealer has been arrested in Palam Vihar for allegedly raping a 29-year-old air hostess, who was a tenant in his house.

The victim, who is an employee of a Delhi-based airline, had been living in Celebrity Suite Apartments for the last five years and she claimed that she trusted her landlord, Rajiv Bagga, when he got intimate with her and promised to marry her. A source said that Bagga was already married twice and the victim had been involved with him since 2008. She had pleaded with him to marry her earlier but he had calmed her with the promise of gifting her a flat. Some days ago, when she got to know that the promised flat had already been sold by Bagga, she felt duped.

Student held for rape after promising to marry model

PUNE: The Kondhwa police on Friday arrested a student of marine engineering in a city-based college for allegedly raping a model on the pretext of marriage in 2012-'13. 

The suspect, Avinash Arvindkumar Mishra (23), of Gujarat, presently residing at Undri, was arrested after the 21-year-old victim lodged a complaint against him. 

Senior inspector Pandharinath Mandhare said Mishra, a third-year student of marine engineering, befriended the girl, a model by profession, at a city pub a year ago. 

According to Mandhare, the suspect promised to marry the girl and had an intimate physical relationship with her. The two later started staying together in a live-in relationship. He said the relation between Mishra and the victim turned sour after he forced her to abort a pregnancy. Mishra also allegedly sold the girl's car. When Mishra failed to fulfill his promise of marriage, the girl registered a complaint against him, following which he was arrested. Mishra was charged for allegedly committing an offence of rape, cheating and criminal breach of trust under sections of the Indian Penal Code, Mandhare said.In another incident, the Khadak police on Friday arrested Rushi Suresh Kothari (25) for allegedly raping an 18-year-old girl on the pretext of marriage. The police said Kothari allegedly snapped obscene photos of the girl on his mobile phone and uploaded these on a social networking site. He also threatened to disfigure her with acid if she disclosed their relationship.

CJI Balakrishnan admits to misuse of dowry laws

NEW DELHI: Dealing a blow to women's rights activists who have been stringently defending the Section 498A provision of the Indian Penal Code, Chief Justice of India K G Balakrishnan on Saturday said that in some cases this section — that deals with matrimonial cruelty — was being `grossly misused'.
Elaborating on false cases being filed in recent times, the CJI said that relatives not involved with a matrimonial dispute were unfairly implicated. Ludhiana cops want to travel free in trains when on official visit

Policemen from the region have at least one thing in common - most of them think they don't need a valid ticket for travelling in trains. At least six cops have been caught without ticket in past four days in different trains. The erring cops were fined and the reason cited by them for not buying the ticket was the same - they are on an official visit and thus don't need a ticket.
If railway staff are to be believed, some of the erring cops even threatened the ticket-checkers of dire consequences.
Nirmaljit Singh, a head constable posted at Basti Jodhewal police station was caught without ticket on October 7 when he was travelling in the Uttar Sampark Kranti train from Delhi to Ludhiana.
Travel ticket examiner Jasvinder Ratti said when he asked the cop to produce ticket, the cop brazenly refused saying he was on government duty. Ratti said he asked the cop to pay with fine, who reluctantly paid the same after security was called to the spot.
On September 4, Ratti had caught three cops, including one from Ludhiana, travelling without ticket. Head constable Surjit Singh from 3rd Indian Reserve Battalion (IRB), Ludhiana, was travelling in the Shalimar Express from Ludhiana to Chakkibank without ticket. On the same day, Vikas Kumar and Narinder Kumar, both from Haryana Police, were also caught without ticket in the same train.

The police department used to issue a warrant to cops going to other states to perform duty. The cops have to produce the warrant at the booking window to exchange it with a valid travel ticket for free, but all the cops don't follow rules and most of them are in the habit of travelling without ticket.

Accused of dowry death, Salem Tabri man tries suicide

A Salem Tabri resident who had been at large after he was accused of his wife's dowry death allegedly attempted to commit suicide by consuming poison here on Saturday night.

Sanjiv Kumar's condition is said to be stable. He is being treated at Dayanad Medical College and Hospital (DMCH). Police have now booked him for attempt to suicide under section 309 of the Indian Penal Code (IPC). 
A resident of New Aman Nagar in Salem Tabri, Kumar's wife Vaishali, 24, was found hanging from a ceiling fan in her bedroom on Friday. On the day of her death, Kumar, his father Pardeep Kumar and mother Kanta Rani had said that she had killed herself as she had been depressed because of a miscarriage. However, the three were booked for dowry death under section 304-B of the IPC on Saturday after Vaishali's father Mahabir Singh, a resident of Delhi, reached the city and alleged that Vaishali's husband and in-laws often used to harass her daughter for dowry.

Police have not been able to ascertain the place where Kumar was hiding and where he consumed poison. Inspector Balwinder Singh, the station house officer of Salem Tabri police, said they received information about Kumar being wheeled into DMCH while they were making attempts to arrest him and his parents. Kumar's parents are still at large.

Man hangs self, blames wife and lover on video

MUMBAI: In probably the first case of its kind, a 38-year-old driver hanged himself in the early hours of Tuesday after calmly recording a 19-minute video on his cell phone accusing his wife of 18 years and her paramour -and a policeman in part -of driving him to suicide.

Sunil Ugde was found hanging in his hutment in Agripada in central Mumbai around 2am by his mother. The family found a note in Marathi, asking them to check the video.

In the recording, Ugde claimed that his wife Anuradha would often run away with her paramour, Abdul Wahab alias Chhotu, and "both should be held responsible for my death".

"I had asked sub-inspector (Ajit) Kadam of Agripada on Sunday night to help me get back my wife... (who) was with Chhotu. If he had believed me and summoned and questioned Chhotu, this situation would not have arisen. Kadam made fun of me and sent me home without doing anything. I was left with no option...," Ugde has said.

Anuradha and Chhotu, a married 38-year-old taxi driver from the same slum, have been arrested.

The Agripada police have charged Anuradha, wife of Sunil Ugde who committed suicide on Tuesday and blamed her and her paramour for his death in a video, and Abdul Wahab alias Chhotu with abetment to suicide and criminal intimidation under IPC sections 306 and 506. "Both the accused were produced before court and remanded in police custody till Friday. Further probe is on," said Kishore Bhaviskar, senior inspector of Agripada police.

He refused to comment on Ugde's allegations against Agripada cop Ajit Kadam. "I had asked sub-inspector Kadam of Agripada on Sunday night to help me get back my wife, who had been missing for 15 days. I told him my wife was with Chhotu. If he had believed me and summoned and questioned Chhotu, this situation would not have arisen. Kadam made fun of me and sent me home without doing anything. I was left with no option... She (Anuradha) often ran away with Chhotu. I am a driver and often have to go out of station for days, and people used to taunt me about my wife. I am ending my life; both should be held responsible for my death. I request senior police officers to watch this clip and give me justice," Ugde said in his recording. TOI has a copy of the clipping, which, a lawyer said, cannot be used as substantial evidence to prove abetment of suicide, but could be corroborative evidence.

Ugde's family have washed their hands of Anuradha. "My son spent his life trying to convince his wife to leave Chhotu, but she ditched him. Now let her face the consequences. Neither I nor my grandchildren have any pity for her," said Ugde's mother Hira, sitting in their 10ftx10ft hovel.

Incidentally, the Ugdes' home is bang opposite the hutment of the juvenile arrested for the photojournalist's gangrape at Shakti Mills in August.

The family said Ugde, who worked with a tour operator, had often confronted Chhotu, who lived a few metres from his shack in the Jai Bhawani Nagar slum at Dhobi Ghat with his wife and children, and asked him to leave his wife alone. "Last month, when Sunil told Chhotu to lay off his wife, he threatened him with dire consequences," said Hira, claiming that Anuradha had been in a relationship with Chhotu for seven years.

"She often ran away without any notice for two to three months. Somebody said it was the result of black magic. I took her to Pune and treated her, but nothing changed... The children are growing up, I cannot answer them why she goes missing. By doing this, she is not only spoiling my life but also the children's future. I am sick of her, I am left with no option but to commit suicide. I request the police with folded hands to take strict action against both of them," Ugde said in the recording.
