Executive who forced wife to watch porn & beat her told to pay Rs 20, 000 every month

MUMBAI: A family court has directed an executive to pay a monthly maintenance of Rs 20,000 to his estranged wife, who among several allegations had said that he committed cruelty by forcing her to watch pornographic films. The woman also claimed that when she refused to watch such films, he beat her until her ear bled.

Stating that the man had not challenged these facts, the court observed, "It can be seen that the petitioner [wife] has proved her case that the respondent [husband] treated her with cruelty and has deserted her." The 34-year-old woman had filed the petition in April 2009.

She had got married in February 2001 and lived in a joint family. In 2005, she gave birth to a girl. Among the other allegations levelled against her husband, the petitioner had said that she was made to abort on two occasions. She further alleged that her in-laws had demanded Rs 50,000 from her parents and refused to let them visit her until they paid the money.

The petitioner claimed that her in-laws had sold her ornaments to buy a flat at Virar, and later threw her and her husband out of the house in June 2003. The couple moved to a house in Parel. She alleged that in 2008, her husband threw her out of the house and she moved in with her parents.

Last week, the petitioner told the court that her husband worked at a private firm in Goa and earned Rs 50,000 a month. She sought maintenance for herself and her daughter. But in his reply, the husband alleged that her "misbehaviour" at his workplace had resulted in his termination, and his monthly income was only Rs 6,000. He told the court that his wife did not "adjust well", wanted a luxurious life, and insisted on flying from Goa to Mumbai, which resulted in him incurring heavy debt. Claiming that his wife, who had done a computer course, was employed, he prayed for dismissal of the petition.

The court said according to the Indian Evidence Act, it is for the person who has the knowledge of the fact to produce the proof. "The respondent [husband] has neither produced his salary certificate nor given his evidence. He has also failed to produce any document to show that his services have been terminated," the court said.
