High court stops NRI from seeking divorce in US

NEW DELHI: The Delhi high court has come to the rescue of a woman allegedly deserted by her husband who has filed for divorce in the US.
In a recent ex-parte order, Justice Mukta Gupta restrained the husband from proceeding with the divorce petition filed in a Texas court. She took into account that the couple had tied the knot in India and now the woman doesn't possess a valid visa to travel to the US and contest the divorce plea.
"The balance of convenience lies in favour of the wife and if injunction isn't granted, she will suffer irreparable loss," Justice Gupta said.
HC accepted the argument of the woman's lawyer, Prabhjit Jauhar, that since they were married in India in accordance with Hindu Marriage Act, 1955, their marriage could only be dissolved under the provisions of the Act. He further said the US court has no jurisdiction to resolve the marriage.
According to the petitioner, she was suddenly left stranded by her husband who filed for divorce in the US on the ground of irreconcilable differences. She told the court that soon after their marriage, they left for the US. While initially the husband was staying in a rental accommodation, the couple shifted to a home they had purchased.
Their relationship turned sour when the husband and his parents started treating the woman with cruelty and demanded that her parents transfer one of the properties in the name of the husband. When the woman's parents pleaded helplessness, the husband allegedly conspired with his parents to oust the woman from their house.
HC was further told by the woman's counsel that she was sent back to India for a holiday with a return ticket to the US. But, once she was gone, the husband did not apply for her green card because of which the woman's dependent visa expired. In her absence, the husband got his green card and filed the divorce petition.

Middle-aged man commits suicide

A 35-year-old man allegedly 

committed suicide following harassment by wife and in-laws, police said today. 

Sudama Batham, a resident of Barthara gate at Gohad in the district, had a dispute with his wife, who had earlier lodged a case of dowry demand against him which is pending in a

His wife had been living with her parents for the last one year and all this led to his depression. 

Sudama hanged himself from a ceiling fan in his house yesterday. 

Police have registered a case and further investigations are on.

The Telegraph Calcutta : SC clears woman of dowry death case

New Delhi, Dec. 30: The Supreme Court has acquitted a woman convicted of forcing her sister-in-law to take poison in a dowry death case, saying police, prosecutors and judicial officers had not taken into account a document as vital as the viscera report.
Justices Ranjana Prakash Desai and J. Chelameshwar said such “callousness” was bound to shake the faith of society in the criminal justice system.
“Public prosecutors and judicial officers owe a greater responsibility to ensure compliance with law in a criminal case. Any lapse on their part such as the one which occurred in the instant case is bound to jeopardise the prosecution case resulting in avoidable acquittals,” the bench said.
“Inefficiency and callousness on their part is bound to shake the faith of the society in the system of administration of criminal justice in this country which, in our opinion, has reached a considerably lower level than desirable.”
The top court, however, said the woman’s conviction under Section 498A (harassment by husband and other family members) stood, as the lower courts had reached “concurrent” findings based on evidence of cruelty as explained in the penal code section.
The ruling means Kamala Devi, who had been handed jail terms of seven years under Section 304B and two years under Section 498A, has been cleared of the graver charge of dowry death.
A sessions court in Gaya, Bihar, had convicted Kamala, brother-in-law Suhas Sao, the husband of the deceased, and Chhotan Sao, the father in-law, under the two sections for the 1991 death of Babita Devi.
According to the prosecution, Babita’s brother Surendra Prasad had filed an FIR in November 1991, saying his sister was assaulted with a stick and forced to consume poison by the three. Patna High Court later upheld their sentence.
Suhas did not challenge the sentence, but Chhotan and Kamala moved the apex court. Chhotan died while hearings were on. The top court said the trial court had convicted the accused despite noting in its judgment that the prosecution had not submitted the viscera test report to establish the allegation of poisoning.
In its judgment, the trial court had said “it would appear that (the) viscera was sent for post mortem but that report has not been received”. It also said “no apparent injury, external or internal, has been found on post-mortem examination of the dead body”.
In its recent ruling, the apex court said it was on the basis of “such scanty medical evidence” that the trial court and the high court had “rushed to the conclusion that the death of Babita Devi occurred ‘otherwise than under normal circumstances’”.

Woman held for ‘killing husband with lover’s help

Kulgam: A woman has been arrested on charges of killing her husband with the help of her lover in this south Kashmir  district and later trying  to pass it off as a  suicide by hanging his body on a tree, police say.
Abdul Rashid Dar  was “tortured and mercilessly killed” at his home in  Motargam village  by his wife Muzmila Akhter and her lover Ali Mohammad Dar .
“Rashid’s  body was found  hanging from a tree at an  orchard in the village on December 21 .  Post-mortem report revealed that the deceased’s private parts bore torture marks and his neck was broken,” Superintendent of Police Kulgam, Mumtaz Ahmad, told Kashmir Reader.
A case was registered in Police Station Kulgam  and during the course of investigation suspects were brought in for  questioning , he said.
“It came to light that one of the suspects  had developed illicit relations with the wife of the deceased and both of them were arrested and during sustained questioning revealed that the deceased had become a hurdle in their affair . They hatched a conspiracy and mercilessly  killed him during the intervening night of 20- 21 December  at his residence,”  Mumtaz said.
The duo further revealed that they shifted the body outside the village and hanged it on a tree in an orchard to pass the death as suicide, he said.

Zeenat Aman to star in bilingual film on sex abuse

Veteran actror Zeenat Aman has starred in a bilingual movie 'Strings of Passion' dealing with the unexplored subject of sexual torture of male models and extras.

Zeenat, 62, who acknowledged ignorance about such a practice, told the director of the movie, Sanghamitra Chowdhury, "Frankly, I did not know that it exists in our industry."

The yesteryear star plays the role of the mother of one of the three protagonists in the movie, which is a Hindi-English production. "I had scripted 'Strings of Passion' based on my research and interviews of directors, producers, cast and wannabe actors in Hindi films, who had confided me on sexual exploitation of some male model-extras. These models are desperately in need to be in reckoning. Usually they are abused as gigolos," Sanghamitra said.

Sanghamitra said the title of the movie does not reflect the subject she is exploring in the movie. "I had actually thought about 'Strings of Passion' as the story of three buddies Amit, Manu and Neel played by Trishan, Girish and Shubh respectively whose music band Strings Of Passion was the cementing factor," she said.

"As one key lyricist-member commits suicide, the friends meet after three years and relive their past. But from this story emerged a different tale as I could not keep the issue on the back-burner again," she said.

Zeenat, playing Manu's mother and a close friend of her son's group, is turning up in a Bengali director's work for the first time while 'No One Killed Jessica' actor Rajesh Sharma plays the father of one of the children.

The film will be released in January with Zeenat scheduled to come to the city to attend the premiere.

इंग्‍लैंड के वॉस्‍टरशायर के एक पोस्‍टमैन को उस जुर्म की सजा मिली जो उन्‍होंने कभी किया ही नहीं था. जी हां, 53 वर्षीय विक्‍टर नियलन को रेप की कोशिश करने का दोषी करार दिया गया था और उन्‍हें 17 साल जेल में गुजारने पड़े. और अब 17 साल बाद पिछले साल दिसंबर में उन्‍हें बाइज्‍जत बरी कर दिया. विक्‍टर पुलिस के खिलाफ मुकदमा दायर करने के बारे में सोच रहे हैं.आपको बता दें कि जब पीड़ित महिला के ब्‍लाउज में मौजूद डीएनए सबूत की जांच की गई तो पता चला कि रेप की कोशिश विक्‍टर ने नहीं बल्कि किसी और शख्‍स ने की थी. सबूत के सामने आने के बाद दिसंबर 2013 में विक्‍टर को जेल से रिहा कर दिया गया.
हालांकि अपनी जिंदगी के कीमती 17 साल जेल में गुजारने के बाद भी विक्‍टर के मन में जेल प्रशासन के खिलाफ कोई कड़वाहट नहीं है. विक्‍टर को जनवरी 1997 में 22 साल की लड़की का रेप करने की कोशिश के अरोप में आजीवन कारावास की सजा सुनाई गई थी.
विक्‍टर का कहना है कि वे इतने सालों तक इसलिए चुप रहे क्‍योंकि उनके वकीलों की टीम उनका बचाव करने में असमर्थ थी और उन्‍हें लगता था कि गुनाह कबूल कर लेने से सजा कम मिलेगी. उन्‍होंने कहा, 'पुलिस के पास कभी भी मेरे खिलाफ कोई सबूत नहीं था, लेकिन मेरे वकीलों की टीम केस सही से नहीं लड़ सकती थी. अब न्‍याय का वक्‍त है और मैं अपनी जिंदगी वापस चाहता हूं'.
विक्‍टर के मुताबिक, 'मैंने केस की दोबारा जांच करने के लिए पुलिस से बात की है और मुझे लगता है कि पीड़िता को भी इसमें शामिल होना चाहिए. क्‍योंकि पीड़िता को न्‍याय मिलना ही चाहिए'.
जेल से रिहा होने के बाद दिसंबर में विक्‍टर ने अकेले ही क्रिसमस मनाया क्‍योंकि उनके लिए आजादी ही काफी थी. उनका कहना है कि उनके बच्‍चे नहीं हैं और इस बात का उन्‍हें सबसे ज्‍यादा अफसोस है. लेकिन 2014 के लिए उन्‍होंने कई योजनाएं बनाई हैं. वो वर्ल्‍ड टूर करना चाहते हैं. फिलहाल, तो विक्‍टर अपनी आजादी का जश्‍न मना रहे हैं.
